. firefighters had to go in a defensive mode and fight the flames from the outside of the building. they used water and houses and ladder trucks here. there was also concern about this spread to other buildings. that meant neighbors had to evacuate. >> fire was threatening adjacent structures to the rear and the side of the building. we also had a rescue in which berkeley police officers helped remove a woman who was in a wheelchair. there were four other occupants able to get out of the building. >> reporter: he said the fire, the policeman who helped that woman in the wheelchair get out, he considers them heroes. everyone okay. no injuries to report. the red cross is helping the five people who live in the home, they're at a nearby hotel. building inspectors should be here by day break to check the duplex. they're concerned because essentially the rear of this home is gone and they may have to excavate, get some of the debris out of the way, and they're really concerned about the structural integrity. they say they will prefer to do all that sort of work when they can really see what they'r

as they were clear that they were able to address this fire pretty aggressively. they went to a defensive mode where they were using a ladder and addressing it from the inside. ruth basically collapsed and caused a lot of pockets and there are lot of places for fire to collect. it was quite a bit of a battle for the firefighters but they were eventually able to put this fire out. their main concern after knowing everyone safe an outhouse was the adjacent homes. these sums are pretty close by and there's a lot of brush and trees around here, at one time these people also had to be evacuated. they are now back in their homes. investigators are on the scene and now it is daylight they can see exactly what caused this fire. >> violence is continue to escalate in oakland. a man was shot and killed yesterday afternoon and that was the fifth murder in oakland and less than 24 hours. investigators say the recent shooting was being investigated and they're not sure if it is related to the other four murders that happen in the past 24 hours. we learn more about one of the victims killed yesterday mornin

that the court has exempted yet for the defense of marriage act. a federal circuit court has felt that that law in one provision is not constitutional. the provision forbids the government from recognizing same-sex marriages. this law was passed before any state performed same-sex marriage. there are 3 or four other states to recognize same-sex marriages starting next year. the question before the court and the one that this record in boston and several district courts is whether it is justifiable for the government to deny benefits to same-sex spouses. those courts found there is a significant justification to target this group. we're talking about survivor benefits. a same-sex spouse dies and is the spouse and tile to death benefits, that kind of thing. there is no justification for the government to substitute its view of marriage for that of a state. the government has always accepted a state's own definition of marriage. host: him from georgia -- kim. caller: i don't think the supreme court can usurp state's rights. they should not always be taken to task by the supreme court. it is a fede
